Terms and Conditions

Effective: September 22, 2025

These Terms and Conditions govern your use of our website and all services provided by WebDev & Design LLC. Where a specific service page or written agreement contains terms that differ from these Terms and Conditions, the service-specific terms govern for that service. Anything not addressed in a specific service page is governed by these Terms and Conditions.

Services

We provide web design and development, e-commerce websites, landing pages, website redesigns, SEO and content strategy, digital advertising (Google & Meta), social media management, photography, videography, brand design, website content updates, WordPress maintenance, and ongoing support services. We also offer website subscription plans for small businesses and non-profit organizations. Services may change or be updated at our discretion.

Payments

• Accepted Payment Methods We accept payments via Stripe, Google Pay, Apple Pay, Venmo, Afterpay, and Affirm. Payment terms vary by service type as described below.
• Website Design Projects (paid-in-full) A 50% deposit is required to begin. The remaining 50% is due upon delivery.
• Website Subscription Plans Includes Small Business, Non-Profit, and any other monthly website plans. Billed monthly, prepaid. The website design is licensed to the client while the subscription is active. Current pricing is listed on the applicable service page.
• E-Commerce & Landing Page Projects A 50% deposit is required to begin; the remaining 50% is due upon delivery. Payment Plan options may be available, see Payment Plans below.
• Brand Design & Launch Kits Prepaid in full, or 50% deposit at the start with 50% due upon delivery, based on project scope and written agreement.
• Photography & Videography Projects Prepaid in full, or 50% deposit at the start with 50% due upon delivery, based on project scope.
• Monthly Services (SEO, digital advertising, social media management, content updates) Billed 100% prepaid each month. Discounts are available for 3–6 month prepaid commitments.
• WordPress Maintenance & Flat-Rate Packages Prepaid in full per billing cycle, as specified on the applicable service page. When work exceeds the scope or hours included in a flat-rate package, additional work is billed at our standard hourly rate.
• Retainers Monthly retainers (Starter, Standard, and Growth tiers) are prepaid each month. Work performed beyond the included hours is billed at our standard hourly rate. Current retainer pricing and hourly rates are listed on our website.
• Revisions Each project includes a set number of revision rounds as specified on the applicable service page. Additional revisions beyond that limit are billed at our standard hourly rate.
• Payment Plans (Installment Options) Some services are available as Payment Plans, splitting the total cost into multiple scheduled payments. Payment Plans carry no interest when paid on schedule.
• If a scheduled payment is not received within 10 days of its due date, a late fee of 10% of the overdue amount will be applied. Each subsequent month the balance remains unpaid, the 10% fee is recalculated on the full outstanding balance — including any previously accrued late fees — making the charge accumulative until the account is brought current.
• Example: A $300 installment goes unpaid. After 10 days, a $30 late fee is added ($330 due). If still unpaid the following month, 10% is applied to the $330 balance, adding $33 (total: $363), and so on.
• Repeated missed payments may result in suspension of services, removal of website access, and referral to a collections process.
• General All invoices are due by the date specified. Unpaid invoices may result in suspension or termination of services. All payments are non-refundable unless otherwise stated in these Terms or on the applicable service page.

Ownership

• Paid-in-full projects: client owns website, code, domain, and hosting.
• Subscription sites: WebDev & Design retains ownership; use is licensed while subscribed.
• Photography/design: clients receive usage rights; we may use assets in our portfolio or training unless otherwise agreed.

Support & Maintenance

• All websites include at least 1 week of launch support.
• Ongoing maintenance and updates may be covered under a monthly retainer, billed at our standard hourly rate, or offered as a flat-rate package (as specified on the applicable service page). When work exceeds the hours or scope included in any plan or package, additional work is billed at our standard hourly rate or may be added to an active retainer.

Security

We implement SSL, trusted plugins, updates, and backups (per plan). No website can be guaranteed “un-hackable.”

Cancellations

• Project Cancellations Projects may be canceled at any time, but all deposits and payments made to date are non-refundable. If a project is canceled after work has begun, WebDev & Design reserves the right to invoice for all work completed up to the cancellation date.
• Monthly & Subscription Service Cancellations Monthly services — including website subscriptions, SEO, digital advertising, social media management, content updates, and maintenance plans — require a minimum of 30 days written notice to cancel. Notice must be submitted to hi@webdev-design.com.
• If a cancellation request is received within 15 days of the next scheduled billing date, a cancellation fee equal to 50% of that month’s service cost will apply, to offset scheduling and resource commitments already made. Because these services are prepaid and offered without long-term contracts, no refund is issued for the current billing period.
• For subscription website plans, access to the website and all hosted files will end upon cancellation or if recurring payments are not received.

Liability

We are not liable for indirect, incidental, or consequential damages (e.g., lost revenue, downtime). Our maximum liability is limited to the fees you paid us in the past 3 months.

Law

These terms are governed by Utah law. Disputes will be resolved in Utah courts.

Changes

We may update these terms at any time. Continued use means acceptance.
